Immigration
U.S. Immigration laws allow Green Card, Citizenship, and U.S. visa applications through the Employment based category, the Family-Based category, and the Diversity Visa lottery program.
Family Sponsorship: This category is applicable to people who want to obtain a Green Card, Citizenship, or U.S. visa based on a relative who is either a Permanent Resident or U.S. Citizen. More information on this topic is available here.
Employer Sponsorship: Employment or an offer of employment by a U.S. employer is usually required in advance, and a “Labor Certification” (also known as PERM) must usually be obtained from the Department of Labor. There are exception categories for highly qualified persons. The Foster Law Group P.C. website details the various employment visas here.
Diversity Visa Lottery Program: The Congressionally mandated Diversity Immigrant Visa Program makes available 50,000 diversity visas (DV) annually, drawn from random selection among all entries to persons who meet strict eligibility requirements from countries with low rates of immigration to the United States. Contact Foster Law Group P.C. today for more about this program.
A Green Card or Permanent Resident Card serves as proof of a person’s lawful permanent resident status in the United States. An individual with a Green Card has the right to live and work permanently in the United States. A person’s valid Green Card also means that he or she is registered in the U.S. in accordance with United States immigration law. More information about Green Cards and the various types of visas you may qualify for is available here.
Green Card holders have several privileges including:
- The right to live permanently in the United States
– The right to work in the United States
– The right to travel abroad for a certain period of time
– The opportunity to apply for U.S. citizenship after a certain number of years
– The right to petition for a Green Card for the applicant’s spouse and any unmarried children under 21 years of age
There are various ways to qualify for a Green Card and a person may have several choices on how to apply. For example, a person may qualify for a Green Card through employment but also qualify for a Green Card through a relative. In this scenario it is important to understand what type of application will be more likely be approved and processed faster.
